Abba Kayari: Spoliation And Remedies At Law


Can someone tell ABBA KAYARI that the FBI agent in charge of his case now has a legally sufficient PROBABLE CAUSE to subpoena Facebook for his now-deleted post?

By deleting the post, too, and while under a criminal investigation, he engaged in SPOLIATION, a no-no for someone under investigation (those in charge of the investigation should construe the action against him). If you deliberately destroy evidence, you are setting yourself up for failure.

At law, pursuant to the federal rules of civil/criminal procedures, once an investigation begins, ALL parties are expected to PRESERVE all relevant evidence. If a party deliberately destroys a piece of ADVERSE evidence, there are remedies at law, including, inter alia, sanctioning the party, issuing a contempt citation, and limiting what the party can introduce into the evidence pool.

SPOLIATION applies to not only paper documents, as it applies to Electronically Stored Information (ESI): Facebook posts fall under the latter category.

By removing the Facebook post, Abba Kayari MUST be sanctioned for ESI spoliation. If he could destroy ESI, imagine what he would have done to other tangible evidence.

Also, the investigators (those mandated by the IG to investigate Abba Kayari) should have issued a SPOLIATION ORDER against him. If he deleted the post after receiving the SPOLIATION ORDER, then he should be charged, in addition to other charges, with undermining the administration of justice.

In a criminal matter, evidence tampering is a SERIOUS OFFENSE, and Abba Kayari should know better.
